Legal opinion

A data trust for research on right-wing extremist mobilisation, agitation and radicalisation needs a legal basis for processing personal data in the database. We have had this legal basis examined as part of a legal opinion. As a result, the processing of personal data is based on the provisions of Sec. 27 (1) BDSG (in conjunction with Art. 9 (2) lit. j GDPR). Accordingly, the processing of personal data for the purpose of scientific research is permitted if the public interest in the research outweighs the legitimate interest of the data subject. This means that there must be clear criteria for inclusion in the database, and the personal data must be protected from unauthorised access by appropriate measures. Appropriate technical and organisational measures are planned (see among others the provisions in the Code of Conduct and in the Data Use Agreement). The legal opinion will be published here as soon as it has been approved by all participating researchers.
